A pedestrian was hit and killed early Tuesday morning in Austell, Georgia, in a tragic incident that highlights the dangers pedestrians face on busy roadways. The Cobb County Police Department (CCPD) reported that the accident occurred shortly before 7 a.m. at the intersection of Austell Road and Anderson Mill Road.

The victim, identified as 25-year-old Comfort Nkenganyi of Lithia Springs, was crossing Austell Road when the tragedy unfolded. According to CCPD’s preliminary investigation, Nkenganyi was using the crosswalk but did so against the “Do Not Walk” signal. As she entered the road, she stepped into the path of a white 2021 Toyota Highlander. Despite the driver’s efforts to avoid her, the vehicle’s front left side struck Nkenganyi.

Tragically, the incident did not end there. Police say at least two additional vehicles struck Nkenganyi and fled the scene without stopping. The driver of the Toyota remained at the scene and cooperated with authorities, but the hit-and-run drivers remain unidentified. Sadly, Nkenganyi was pronounced dead at the scene by the Cobb County Medical Examiner’s Office.

The CCPD continues to investigate this heartbreaking collision. They urge anyone with information about the incident or the fleeing vehicles to contact them at 770-499-3987.

Compensation at Stake for Victim’s Family

In pedestrian fatalities such as this one, the family of the victim may be entitled to pursue compensation for their tragic loss. Potential claims could include compensation for funeral and burial expenses, medical bills incurred before death, loss of income or financial support, and emotional suffering. Additionally, in cases involving hit-and-run drivers, punitive damages may be pursued to hold those responsible accountable for their reckless behavior.

The family may also face legal challenges when navigating insurance claims, especially if multiple parties are involved or if drivers at fault remain unidentified. This is where having skilled legal representation becomes crucial.
